We reserve the right to make technical and formal alterations to improve our products or to meet modified statutory requirements. Current data will be supplied on request. Terms and specifications laid down on www.erco.com are the present state of the art.

Many products are protected by industrial patent rights. Unless specifically indicated, all luminaires will be supplied without lamps. All dimensions are in millimetres.

The lamp wattages indicated are always maximum values. Lower wattages may be used if the lamp dimensions are the same. Voltages given refer to a mains frequency of 50 / 60 Hz. All electrical equipment is to be installed in accordance with IEC regulations and local authority requirements. The local authority should be consulted if further information is required. In accordance with the British Health and Safety at Work Act 1974, Section VI, products supplied by ERCO contain safety instructions and information pertaining to the correct usage and installation of products. The act imposes upon the users of the products, the obligation to ensure that all pecompetencennel involved in the installation, handling, use and disposal of these products are acquainted with the information provided, and made fully aware of the precautions that need to be taken. As the responsibility for correct installation lies with the user, ERCO are to be contacted directly prior to the installation for any further information or explanation which may be required. The installation of ERCO products should only be carried out by competent pecompetencens in accordance with the instructions supplied with the products.

The standard finish of our products is specified in the product description. The products can also be finished in the following colours: white RAL 9002, white RAL 9010, silver RAL 9006 and black RAL 9011 at extra charge. Prices and delivery times for any other RAL or BS colours are available on request.

Quality Management ISO 9001

The ERCO Quality Management System has been organised in accordance with DIN ISO 9001 (EN 29001) since October 1993. This was acknowledged by the DQS (Deutsche Gesellschaft zur Zertifizierung von Qualitätsmanagementsystemen) and confirmed by licenses no. 1151 and 2083 for FORTIS.

The Quality Management System includes: design/and development, production, assembly, sales and after-sales services. The Quality Management System applies to all subsidiary companies of the ERCO Group.

It includes:
Management responsibility, Quality Management System, contract review/sales, design control/development, document and data control, acquisition/purchasing, control of purchaser supplied products, product identification and traceability, process control/production, inspection and testing, inspection, measuring and test equipment, inspection and test status, control of non-conforming items, corrective action and prevention, handling, storage, packaging, protection and delivery, control of quality records, internal quality audits, training, after sales service, statistical methods. The photometric data is based on the maximum wattages allowed and silver reflectors. Illuminances and light beam diameters are provided for narrow beam reflector lamps next to each product. The abbreviated lamp references comply with the ZVEI lamp designation system.

The software of ERCO Leuchten GmbH (ERCO plug-in) provided on www.erco.com is available to the user.

In addition to these General Business Terms, the provisions of the corresponding license agreement are applicable for software delivered as a third-party product or service. They are enclosed with the corresponding product or are available with it. You declare explicitly to accept the license agreements.

Proprietary names / Trademarks

Some terms and product names which are used on www.erco.com are proprietary names registered for ERCO in Germany, in Europe or internationally. However, the use of these proprietary names on www.erco.com does not mean that property rights in the used proprietary names are claimed in those countries where identical or similar proprietary names have already been registered by third parties.

All product and firm names on www.erco.com are proprietary names of their corresponding owners. All rights are reserved which are not explicitly granted here.

Warranty

Despite all due diligence, installation of the supplied software/plug-in may cause faults, errors or omissions on our part or on the manufacturer's part or it may cause customer system errors so that we cannot assume any warranty that the products can be properly installed in your system. Accordingly, please make sure that our offered products are compatible with your system.

The demo software by company SpeGa on www.erco.com is made available by ERCO Leuchten GmbH without any explicit or implied promise or warranty of any kind.

Exclusion of liability

ERCO Leuchten GmbH assumes no warranty whatsoever for the up-to-dateness, completeness or quality of the information provided. Liability claims versus ERCO Leuchten GmbH, relating to material or immaterial damages caused by the use of information provided or by the use of faulty and incomplete information are principally excluded as far as there is no demonstrable, intentional or negligent fault on the part of ERCO Leuchten GmbH.

All offers are non-binding and subject to confirmation. ERCO Leuchten GmbH explicitly reserves the right to modify, supplement, delete or discontinue temporarily or permanently parts of the pages or the complete offer without special notice. The latest version of individual products and product data sheets with corresponding specifications are found under www.erco.com.

Except in case of intent or gross negligence, ERCO Leuchten GmbH assumes no liability for damages and consequential damages of hardware and software due to the use of the programs/the ERCO plug-in, during installation, as well as for the proper operation of the programs.

The term "links" always denotes dynamically connecting references. When establishing the original link to another site, ERCO Leuchten GmbH checked the contents of that site to see if any responsibility pertaining to civil law or criminal law was triggered. However, ERCO does not continually recheck the contents of sites linked to its own website for new amendments which could then substantiate such responsibility. Should ERCO Leuchten GmbH determine, or be informed by others, that a specific site to which a link has been provided now triggers a responsibility pertaining to civil or criminal law, it will then remove the link to that site.

ERCO Leuchten GmbH assumes no liability whatsoever for the demo software available on www.erco.com. The software is subject to the provisions by company SpeGa www.spega.de.

Applicable law and jurisdiction

The legal information provided is subject to German law and will be interpreted in accordance with German law. Application of UN purchase rights is excluded.

German courts have exclusive jurisdiction regarding the decisions of any legal actions or proceedings and/or the settlement of any disputes resulting from or in connection with the legal information provided. To this end, each party is irrevocably subject to the jurisdiction of the German courts. Legal venue is Hagen, Germany.

Final provision

Changes to these agreements require the written form and must be signed by an authorized officer of ERCO Leuchten GmbH.

As far as individual parts or individual formulations of these provisions are not, or no longer or not entirely in accordance with the applicable laws, the remaining provisions or formulations will remain unaffected in their content and validity.
